As a Buy to Let Investor when your property was valued for the purpose of arranging your mortgage, the surveyor who did so owed you the investor a third party duty of care to ensure that your property was fairly valued using  appropriate comparables.

In assessing your claim we will seek to establish if the service that you received from the Surveyor was below that expected from a reasonably competent professional and demonstrate both negligence and that as a result you have suffered a financial loss.

To establish negligence we use the ruling of K/S Lincoln and Others v CB Richard Ellis, in which it was determined that a valuer could make errors in the valuation process as long as the final value was within the permitted 10% margin of error.
Using our expertise we will look to establish a valuation variance of at least 15% for the highest chance of success.  We will look at other determining factors and then advise you of our assessment of your claim.
